The short answer
There is no single rule for the 2026–27 academic year. Institutions have moved in opposite directions over the past twelve months: some now publish a default policy that permits AI as a study tool, others have banned it outright for credited work. What is consistent everywhere is that the rule is set at the course level, you are responsible for whatever you submit, and silence in an assignment brief should be read as "not permitted" rather than "fine".
What changed going into 2026–27?
Two things. First, policies stopped being provisional. Where 2023 and 2024 produced hastily written interim guidance, institutions are now publishing dated, versioned policies tied to a specific academic year — which means the rule you learned last year may have been replaced over the summer. Second, the range widened. It is no longer safe to assume your institution's stance resembles the one down the road.
What does a permissive policy look like?
Columbia Law School's 2026–2027 Default Academic Policy on Student Use of Artificial Intelligence, effective 1 August 2026, is a good example of the permissive end. It states plainly:
"Columbia Law School permits the use of AI as a tool to support learning and to perform specific functions as outlined herein."
Note what it does not do. Permission to use AI is not permission to outsource the work, and the same policy is unambiguous about where responsibility sits:
"Students alone are wholly responsible for the work they submit for credit."
It also preserves the instructor's authority to override the default — but only in writing, and with notice:
"Individual instructors may adopt alternative course or assignment-specific policies as long as they do so in writing, at a minimum in the initial course syllabus, and with advance notice to all students."
That last clause is the practically useful one. It means your syllabus, not the institutional page, is the document that governs your course — and that a stricter course rule is entirely legitimate even where the institution's default is permissive.
What does a restrictive policy look like?
At the other end, UC Berkeley School of Law banned AI use for all exams and credited coursework effective Summer 2026. The stated reason matters more than the ban itself: a documented rise in hallucinated citations and flawed analysis in submitted work. That is a failure of verification rather than a failure of tooling, and it is the specific behaviour every policy in this space is trying to prevent.
The University of Chicago Law School has gone further structurally, piloting electronic devices out of core first-year classes from autumn 2026 and requiring upper-level students to defend substantial research papers orally. The trend it represents — assessment redesigned so that AI cannot sit between you and the assessor — is showing up well beyond law schools.
How common is student AI use now?
Common enough that policy is responding to reality rather than anticipating it. A 2026 HEPI survey found 95% of UK undergraduates using generative AI in some form. Assessment is adapting in step, with oral examinations and portfolio-based work rising sharply as institutions move toward formats that test understanding directly.
The practical read for a student: assume your work will increasingly be assessed in ways that require you to explain it. That makes "can I reproduce this reasoning unaided?" the question worth asking of anything you submit.

What should I actually do in the first week?
- Read the AI clause in every syllabus, not just one. Policies are set per course, and the same student can be under four different rules in one term.
- Check whether your institution's policy is dated for 2026–27. If it carries an older date, it may have been superseded — and if it carries a new one, re-read it even if you read last year's.
- Note the disclosure requirement separately. Permission and citation are two different questions, and plenty of policies grant the first while still requiring the second.
- Email your instructor where a brief is silent, and keep the reply. A written answer from the person grading you is the only interpretation that counts.
- Keep drafts and version history for anything substantial. If a question is ever raised, being able to show your working is a far better position than arguing about a detection score.
Does citing the AI tool matter?
Frequently, yes, and it is the requirement students most often miss. Policy templates commonly ask that AI use be acknowledged and cited — including the specific tool and version — and APA, MLA and Chicago all publish formats for doing so. Where a course permits AI but says nothing about disclosure, adding a brief note costs you nothing and removes the ambiguity entirely.
How does this change how I should study?
It pushes the useful behaviour toward understanding rather than output.
